2. Eligibility

• You must comply with all applicable laws and regulations in your jurisdiction.
• Completion of Know Your Customer (KYC) verification may be required before you can invest or trade.

3. Services Provided

• Soft Commitments: Users may indicate interest in land offerings before they are finalized.
• Hard Commitments with Escrow: Users may place funds into escrow to secure shares of property.
• Live Market: Once shares are live, users may buy, sell, and trade fractional land shares.

4. No Guarantee of Returns

Investing in land involves risk. Property values may fluctuate and past performance is not indicative of future results. Fractal Share does not guarantee profits or liquidity.

5. User Accounts & Security

• You are responsible for maintaining the confidentiality of your account login details.
• You agree to notify us immediately if you suspect unauthorized activity.
• Fractal Share may suspend or terminate accounts for violations of these Terms.

6. Payments & Escrow

• All payments are processed securely through third-party providers.
• Funds placed in escrow are refundable only if the offering does not meet its threshold.
• Once escrow closes, funds are non-refundable and represent your investment.

7. Landowner Responsibilities

• If you list property on Fractal Share:
• You must provide accurate documentation (ownership proof, appraisals, zoning).
• Fraudulent submissions will result in removal and possible legal action.

8. Compliance & Disclosures

• You acknowledge that investments may be subject to U.S. securities laws and state-level “Blue Sky” regulations.
• You agree to provide accurate information during KYC and remain compliant with Anti-Money Laundering (AML) requirements.

9. Intellectual Property

All content, branding, and software on Fractal Share are the exclusive property of Fractal Share LLC. You may not copy, modify, or redistribute without permission.

10. Limitation of Liability

• Fractal Share is not liable for:
• Losses arising from investment decisions.
• Downtime, errors, or interruptions of service.
• Third-party actions, including payment processors or escrow agents.

11. Termination

Fractal Share may suspend or terminate access if you violate these Terms, fail KYC, or engage in fraudulent activity.

12. Governing Law

These Terms are governed by the laws of the State of Wyoming, without regard to conflict of law principles.

13. Updates to Terms

We may update these Terms at any time. We will notify you of material changes. Continued use of the platform constitutes acceptance of the updated Terms.
